1. Acceptance of Terms

By downloading, installing, or using the Pinclaw application ("App") or purchasing and using the Pinclaw hardware device ("Device"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App or Device.

These Terms constitute a legal agreement between you and PinClaw Inc. ("we", "us", "our").

2. Description of Service

Pinclaw is a wearable AI voice assistant that connects to your iPhone via Bluetooth. The service includes:

  • The Pinclaw hardware clip with microphone and speaker
  • The Pinclaw iOS application
  • Cloud-based AI processing and voice recognition
  • Optional subscription services for enhanced features

3. Subscriptions and Payments

3.1 Subscription Plans

Pinclaw offers the following auto-renewable subscription plans:

  • Pinclaw Agent Monthly — $49 per month, billed monthly. Includes access to latest AI models, a dedicated cloud server, full voice input/output, scheduled tasks, custom skills, and 1-on-1 support.
  • Pinclaw Agent Yearly — $479 per year, billed annually. Same features as the monthly plan at a discounted rate.

3.2 Free Trial

Some subscription plans may include a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.

3.3 Billing and Renewal

Subscriptions purchased through the App are billed through your Apple ID account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

3.4 Cancellation

You can manage and cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

3.5 Price Changes

We reserve the right to change subscription prices. You will be notified in advance of any price changes, and you may cancel your subscription before the new price takes effect.

4. User Accounts

You must create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App or Device firmware
  • Interfere with or disrupt the service or servers
  • Use the service to transmit harmful, abusive, or objectionable content
  • Resell or redistribute the service without our written consent

6. Intellectual Property

The App, Device firmware, and related content are owned by PinClaw Inc. and protected by intellectual property laws. The open-source components of our software are licensed under the MIT License as specified in the respective repositories.

7. AI-Generated Content

The AI assistant may generate inaccurate, incomplete, or inappropriate responses. We do not guarantee the accuracy or reliability of AI-generated content. You should verify important information independently and use AI responses at your own discretion.

8. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, PinClaw Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, even if we have been advised of the possibility of such damages.

10. Termination

We may suspend or terminate your access to the service at any time for violation of these Terms. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination will survive.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms. We will notify you of material changes by posting the updated Terms on this page.

12. Governing Law

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of law provisions.
